Patient Rights Advocate
Individuals who are involuntarily hospitalized are entitled to a number of rights.
A patient may need representation when their rights are violated at various stages.
At the beginning of the involuntary hospitalization, the patient is entitled to a
hearing in order to establish where there are grounds for a 72 hour involuntary hold
and whether psychotropic medication can be involuntarily administered. If the hospital
requests a 14 day hold, a patient can request a Writ of Habeas Corpus.

- Contesting LPS conservatorships
Donald A. Eisner, Ph.D. J.D. is a licensed attorney and
psychologist. He has a Ph.D. from West Virginia University and a
law degree from the University of West Los Angeles. He was
licensed to practice as an attorney in California in 1988.
Donald Eisner has been a Visiting Professor of Forensic
Psychology at Alliant International University, where he taught
courses on law and ethics in mental health as well as
psychopathology and psychological assessment.
He has testified in State and Federal Court on mental health issues. Dr.
Eisner has written an academic textbook entitled,
“The Death of Psychotherapy: From Freud to Alien Abductions”. He has
published twenty professional articles.
Dr. Eisner has represented individuals who are on involuntary holds and
represented patients at Writs of Habeas Corpus hearings as well as false
imprisonment subsequent to an involuntary psychiatric hospitalization.
