Patient Rights Advocate

Individuals who are involuntarily hospitalized are entitled to a number of rights. A patient may need representation when their rights are violated at various stages. At the beginning of the involuntary hospitalization, the patient is entitled to a hearing in order to establish where there are grounds for a 72 hour involuntary hold and whether psychotropic medication can be involuntarily administered. If the hospital requests a 14 day hold, a patient can request a Writ of Habeas Corpus.

Areas of representation include:

  • Contesting a 72-hour hold
  • Contesting the administration of psychotropic medication on a forced basis
  • Writ of Habeas Corpus hearing
  • Contesting LPS conservatorships
